Texas to continue lawsuit against New Mexico over groundwater use

ALBUQUERQUE, N.M. — The U.S. Supreme Court ruled that the lawsuit regarding use of the Rio Grande can continue.

ALBUQUERQUE, N.M. — Texas will proceed with a lawsuit against New Mexico over Rio Grande water use after a U.S. Supreme Court ruling Monday, according to an article by Chron.

The state of Texas claims that groundwater pumping near the border has deprived Texas farmers and residents of Rio Grande water, the article reported, while New Mexico contends that they are using the water in accordance with the 1938 Rio Grande Compact between the two states and Colorado.

New Mexico has 60 days to file a motion seeking the case's dismissal and then Texas can respond, the article noted.

According to the article, New Mexico Attorney General Gary King claims that a 2008 agreement between the federal government and two irrigation districts in Texas and New Mexico altered the original compact to be unfavorable to New Mexico farmers.
